Terms & Conditions for Personal Photo & Video Services

These Terms & Conditions apply exclusively to personal photography and videography services provided by New Hermits. They do not apply to services offered to businesses, including property photography or other commercial projects. All prices are stated in New Zealand Dollars (NZD).

1. Booking & Payment

A deposit, in the amount stated on the quote or at the time of booking, is required to secure the booking. The remaining balance must be paid in advance as stated on the quote or the booking page. Bookings are confirmed only once the deposit has been received in full.

2. Rescheduling & Cancellation

The applicable rescheduling and cancellation timeframes vary depending on the type of booking and are clearly stated in the quote and or on the booking page at the time of booking. Additional or stricter conditions, including full fee liability, may apply within shorter timeframes as specified in the quote or booking page.

If a cancellation is made outside the stated cancellation timeframe, a full refund will be issued for any amounts paid.

If a cancellation is made within the stated cancellation timeframe, the deposit is non-refundable and will be retained.

Cancellations cannot be requested after the photoshoot has taken place. In this case, full fees apply to cover time, preparation, and production costs.

3. Client Responsibilities

It is the client’s responsibility to be at the agreed meeting point on time. Late arrival will shorten the available time for the shoot. When children or pets are part of the session, they must be supervised by a parent or guardian at all times.

4. Photographer’s Responsibilities

Professional quality images and/or video will be provided in accordance with the package booked. Edited photos and video will be delivered through an online gallery within the timeframe stated at the time of booking. Responsibility cannot be accepted for circumstances beyond control, such as weather, closures, traffic, or client lateness.

5. Delivery of Photos & Video

Images are delivered in JPEG format, including both high-resolution and web-optimised versions. Videos are delivered in MP4 format, suitable for web and social media use. Raw, unedited files are not provided.

Delivery times vary depending on the package and will be communicated at the time of booking.

All editing is carried out in the photographer’s signature style. Requests for significant changes outside the standard editing style may incur additional fees.

Final files are shared through an online gallery, which remains accessible for 30 days. After delivery, files will be stored for an additional 90 days, after which the photographer reserves the right to delete them permanently.

6. Copyright Ownership

All images and video content remain the intellectual property of the photographer. The photographer retains the right to publish a selection of final images for self-promotional purposes, including on their website, portfolio, and marketing platforms, unless otherwise agreed in writing.

7. Usage Rights

Clients are granted personal usage rights for photos and videos, which include sharing on social media, making personal prints, and giving as gifts. Content may not be sold, used for commercial purposes, or submitted to competitions without prior written consent. The photographer reserves the right to use selected material for portfolio, website, and promotional purposes, unless a written request to opt out is received before the session.

8. Liability

While every effort is made to ensure a safe and smooth experience, no liability is accepted for injury, loss, or damage occurring during the shoot. In the unlikely event of equipment failure or unforeseen circumstances that prevent delivery of the final product, liability is strictly limited to a refund of the session fee.

9. Force Majeure

In cases of illness, emergencies, natural disasters, or other circumstances beyond control that prevent the photographer from attending the booking, every effort will be made to reschedule. If rescheduling is not possible, a full refund will be issued.

10. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of New Zealand.
